Terms and Conditions

We take our commitment to the fairness and transparency of how we trade very seriously. Lanka Kade's Retail Terms and Conditions exist to provide clarity and fairness in our trade with all of our customers. These T&C do not affect your statutory rights.

1.       Definitions

1.1.    We / Us / Our  – Lanka Kade (UK) Limited, Unit C Riverside End, Market Harborough, LEI6 7PU

1.2.    You / Your / Yours - any customer buying or placing an order with us for our goods.

1.3.    Goods / Good – any goods / materials or services ordered or purchased by you from us.

1.4.    Retail Terms and conditions – the terms set out in this document and referred to as T&C.

2.       General provisions

2.1.      These T&C only apply to consumers and do not apply to retailers or businesses.

2.1.1.   We define consumers as those who purchase goods for personal use.

2.1.2.   We define retailers or businesses as those who purchase goods for resale or none personal use.

2.2.      These T&C only apply to consumers that purchase goods from us. If you have purchased our goods from another retailer then these T&C are not applicable, and you are required to contact the retailer.

2.3.      In ordering goods from us, you agree to the T&C outlined in this document.

2.4.      In the event that any part of these T&C is found to be void or unenforceable for any reason, this will not affect all remaining terms and these will remain in full effect.

2.5.      Any failure or delay on our part in enforcing or partially enforcing any provision of these T&C shall not be construed as a waiver of any of our rights under these T&C.

3.       Portrayal of products

3.1.      All images and accompanying descriptions are to the best of our knowledge a fair reflection of the goods.Slight variations in colour and appearance may occur from time to time. All sizes and measurements provided are approximate.

4.       Prices

4.1.      All prices stated are inclusive of applicable sales tax at the prevailing rate.

4.2.      Prices are not inclusive of delivery unless stated.

4.3.      We accept payment in GBP (£) only. The exchange rate charged for payment in international currencies by the processing company (Worldpay) may vary to the rate that we use to calculate non-GBP estimates due to intra-day fluctuations. We are not responsible for any price difference caused by these fluctuations.

4.4.      Despite our best efforts, prices quoted on our website may not always be accurate.If a pricing error has been brought to our attention prior to despatch of your order then we reserve the right to suspend your orderand issue you with a new invoice with the correct price. You will then have the option to proceed with your order or cancel it and receive a full refund.

4.5.     Discount codes are not redeemable for any cash equivalents and cannot be used in conjunction with any other offers unless explicitly stated.

4.6.     We are not responsible for any import fees or taxes that you may incur due to ordering goods for delivery outside of the United Kingdom.

5.       Ordering

5.1.      Your order is an offer by you to buy our goods. We only accept your offer, and conclude the contract of sale for the goods ordered by you, when we despatch the goods to you.

5.2.      We do not file details of your order for your access on this website. Therefore you are recommended to print off a copy of these T&C and your email order confirmation for future reference.

5.3.      You are able to place your order through this website, over the phone or via email. If you require assistance then please call us on +44 (0) 1858 463850.

6.       Payment

6.1.      We accept payment from Maestro, Mastercard and Visa cards, and upon request can provide bank details for BACS transfer. Please note that we do not accept cash or cheque payment.

6.2.      We will take payment for the goods upon submittal of your order if placed using this website, and we will email you confirmation of the payment being received by us. Please note that payment confirmation is not notification of acceptance of your order.

6.3.      We process all payments and hold all customer data in alignment with the rules and regulations outlined in the Data Protection Act (1998) and in compliance with the Payment Card Industry Data Security Standard (PCID55). All payments are processed using Worldpays secure online payment gateway.

7.       Delivery

7.1.      This website is only for delivery of goods to customers in mainland UK, IOW, IOM, NI and ROI. We cannot deliver to the Channel Islands, Orkney, Shetland and Scottish islands.

7.2.      Our free carriage offers are restricted to UK mainland addresses only. You are advised to refer to ‘Costs of delivery’ detailed in our FAQ for more information.

7.3.      We do not guarantee delivery dates; we can only provide an estimate. Time is not of the essence with respect to all deliveries made by us.

7.4.      All orders are despatched on a standard delivery service which is quoted at 3 working days for UK mainland addresses. Delivery charges and estimated timescales of transit vary dependent on location.

7.5.      We are not responsible for any loss of or damage to the goods after delivery has been made to you.

7.6.      If you receive your order in an unsatisfactory condition then please sign the carriers’ delivery note as such and retain the packaging for inspection.

8.       Cancellations

8.1.      If you wish to cancel your order then you must call our office on +44 (0)1858 463850 or email orders@lankakade.co.uk immediately. Failure to do so may result in your order being despatched, as we begin to process your order as soon as it is submitted to ensure a prompt delivery.

8.2.      If you cancel your order prior to despatch then we will promptly refund the full value of your order using the original payment method. Please note that it may take up to 14 days for you to receive refunded money into your bank account.

8.3.      If your order has been despatched prior to cancellation then you will need to return the goods in accordance with our returns and refunds policy.

8.4.      You can cancel your order within 14 days of the date that you received your goods. You are required to return the goods within 28 days of the date that you received the goods. Failure to notify us of your intention to cancel your order and/or return the goods within the stated timeframes may result in your refund being refused.    

9.       Returns and refunds

9.1.      We accept returns from you within 14 days of receipt provided that the returned goods are in the same condition and quantity as delivered by us. You have 28 days to return goods after you have notified us of the fault.

9.2.      For UK and EU customers the standard cost of any outbound delivery originally charged to you will be refunded when the entire order of goods is returned in accordance with clause 9.1. For any other location the original postage will not be refunded.

9.3.      You are required to return unwanted goods at your own cost and it is advised that you return goods using a ‘Signed For’ delivery service and retain proof of postage. We will only be able to refund lost goods if proof of delivery is provided.

9.4.      Returned goods should be accompanied by order details including the customer’s name and order number so that the goods can be identified. Failure to do may result in a delay in the refund being issued.

9.5.      The amount paid for the returned goods will be refunded using the original payment method. Please note that it may take up to 14 days for you to receive refunded money into your bank account.

9.6.      We do not accept the return of bespoke or made to order goods.

10.   Faults

10.1.   If you think that the goods you have received are faulty then you must notify us within 30 days of receiving the goods. You can contact our customer service team on +44 (0)1858 463850 or via email orders@lankakade.co.uk.

10.2.   We will notify you if the goods need to be returned for inspection. Any goods that are required to be returned for inspection are expected to be returned within 14 days of us notifying you.

10.3.    Postage for the return of the goods for inspection will be refunded once the fault is confirmed by us.

11.   Exchanges

11.1.   We do not offer exchange of goods. If you wish to replace a returned item with another item, then please place a new order. Any new order will be processed independent of returned items and we will endeavour to process the order as quickly as possible.

12.   Risk and retention of title

12.1.   We retain property in the goods until you have paid all monies due to us. Until such time as property in the goods passes from us to you, you shall upon request deliver the goods to us. If you fail to do so then you agree that we may enter upon any premises owned, occupied or controlled by you where the goods are situated and repossess the goods.

13.   Intellectual property rights

13.1.   You acknowledge that no copyright or any right of intellectual property subsisting or potentially subsisting in the goods is granted to you or is otherwise vested in you by virtue of your order or purchase of the goods.

14.   Governing law and jurisdiction:

14.1.   Any contract between us and you shall be governed by the laws of England and Wales.

14.2.   Any dispute between us and you shall be resolved exclusively by English courts.

15.    Promotion codes

15.1. Promotion codes are only valid for orders placed online.

15. 2. Promotion codes entitle you, at the time of ordering, to a saving on a new order placed with us

15. 3. We reserve the right to decline orders where we believe a promotion code is invalid for the order being placed. 

15. 4. Promotion codes are only valid on specific goods and while stocks last. Promotion codes are not valid on discounted goods, unless otherwise stated. 

15. 5. Only one promotion code can be used per order. 

15. 6. Promotion codes are not valid in conjunction with any other promotion. 

15. 7. Promotion codes that offer discounts are only applicable to the value of the goods. Carriage does not qualify for a discount. 

15. 8. If goods are returned in compliance with our returns policy then the refund value will be the equivalent of the original purchase once the discount is applied, less any shipping. 

15. 9. In the event of part of the order being returned, the value of the discount applied on that order will be spread between the goods proportionately. The sum exceeding this value, less any shipping, will be refunded.

15. 10. Promotional discount will not be applied to replacement goods. If the offer is still valid at the time of returning the goods then you should place a new order using the original promotional code.

15. 11. Free delivery offers only apply to UK mainland on a standard service.

15. 12. Discount will be applied to the cheapest good on promotions where there is a free or half price good, when purchasing multiple goods.
